General Terms and Conditions of Participation

§ 1 Basics & Scope
The organizer of the PACE RACE events is Pace Race GmbH, Stedingerweg 16, 10407 Berlin (AG Berlin Charlottenburg; HR-Nr. HRB 282396 B).
These terms and conditions (hereinafter "AGB") form the basis for participation in all PACE RACE events. They apply to active participants, spectators, and voluntary helpers (volunteers). All legally effective declarations from participants require written form (e-mail, letter) and must be addressed directly to Pace Race GmbH.
§ 2 Participation Requirements & Registration
Registration: Registration is only available online through the official portal. It becomes effective only upon receipt of the confirmation from the organizer.
Health: By registering, the participant declares that there are no health concerns preventing participation and that they have a sufficient level of fitness to participate. Participation is at one's own risk.
Minimum Age: The minimum age for active participation is 6 years. This may vary depending on the distance (see event description).
Minors require a written consent statement from their legal guardians.
Minors must be accompanied by an adult (supervisor) (max. 3 minors per supervisor). The supervisor participates actively in the run.
ID Verification: Age and identity must be verified on the day of the event with a photo ID. Providing false information will result in exclusion without the possibility of a refund.
§ 3 Rules of Conduct & Safety (Operational Safety)
Authority to Issue Instructions: Instructions from the organizer, security personnel, and official crew must be followed at all times. Violations may result in disqualification or exclusion.
Medical Exclusion: The medical service is authorized to remove individuals from the race if a danger to life and limb (self-harm or harm to others) is likely.
Values & Discrimination: PACE RACE is a place of tolerance. The expression of far-right, anti-Semitic, or discriminatory ideology will lead to immediate exclusion and a prohibition from the premises without refund.
Environment & Order: Natural needs may only be met in designated areas. “Littering” (discarding waste outside the stations) may lead to disqualification. There is a strict ban on alcohol and drugs for active participants.
Vehicles: Vehicles of any kind are prohibited on the course and grounds (except in designated parking areas).
§ 4 Limitation of Liability
The organizer is liable without limitation for damages resulting from the injury to life, body, or health that are based on an intentional or negligent breach of duty.
For other damages, the organizer is only liable if they are based on gross negligence or intentional breach of duty. In the event of a breach of essential contractual obligations (cardinal duties), the organizer is also liable in cases of simple negligence, but limited to the foreseeable, typical contractual damage.
The organizer assumes no liability for lost valuables, equipment, or clothing.
§ 5 Image and Sound Rights (Marketing & Media)
By participating, individuals agree that the photos, film footage, and interviews produced in connection with the event may be used free of charge and without temporal or spatial limitations in broadcasting, television, print media, social media, and on the organizer's website.
This particularly includes the use for promoting future PACE RACE events.
§ 6 Tickets, Rebooking & Refund
No right of withdrawal: Since these are services in the field of leisure activities for a specific date, there is no statutory right of withdrawal (§ 312g Abs. 2 Satz 1 Nr. 9 BGB). The order is immediately binding.
Personal nature: Tickets are personalized. A transfer to third parties is only possible with the approval of the organizer and possibly for a processing fee through the online portal.
Cancellation/Force Majeure: If the event has to be canceled due to force majeure (e.g., severe weather, official requirements, pandemic, threat of terrorism) or must be postponed, the organizer is exempt from liability for damages. The organizer reserves the right to modify the event within reasonable limits or to issue vouchers.
Advertising: Any form of "guerrilla marketing" or unauthorized self-promotion by participants is prohibited.
§ 7 Final provisions
If individual provisions of this contract are ineffective, the validity of the remaining terms shall remain unaffected (Severability Clause).
The organizer is entitled to make changes to the GTC for valid reasons (change in law, hygiene regulations), provided that the contractual balance is not significantly disturbed.
